Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the MyCrimeArea.tech website (the "Service") operated by MyCrimeArea.tech ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

1. Introduction to the Service

The Service provided by MyCrimeArea.tech is a web application designed to facilitate community awareness regarding local crime by allowing users to:

  • Create and receive radius alerts for their specified areas.
  • Report incidents, activities, or information related to crime in their local area ("Crime Reports").
  • View Crime Reports and alerts created by other users within their specified areas.
IMPORTANT DISCLAIMER

The Service is NOT an emergency service and is NOT a substitute for contacting emergency services or official law enforcement agencies. In case of an emergency or if you are witnessing a crime in progress, you MUST immediately contact your local emergency services (e.g., 999 in the UK, 112/999 in Ireland) or the relevant police force.

2. Definitions

Service: The web application and all associated features, content, and services provided by MyCrimeArea.tech.
User/You/Your: Any individual accessing or using the Service.
Account: A unique account created for you to access our Service.
Content: Any text, images, videos, audio, or other information created, uploaded, or displayed by users or by the Service.
Crime Report: Any information, including descriptions, locations, times, and other details, submitted by a User through the Service regarding alleged criminal activity or suspicious incidents.
Subscription: The paid plans (monthly or yearly) that grant access to additional features or enhanced functionality of the Service.
Free Model: The basic access to the Service without a paid Subscription.
Governing Law: The laws of England and Wales and the Republic of Ireland.

3. Eligibility and Account Registration

3.1.

To use the Service, you must be at least 18 years old and capable of forming a binding contract.

3.2.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.3.

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Nature of Service and User Responsibilities

4.1. No Emergency Service

As stated above, this Service is not an emergency service. We do not guarantee immediate response to, or action on, any Crime Report or alert. We are not responsible for any failure to act on information provided through the Service.

4.2. Information Sharing for Awareness

The Service is intended for community awareness and sharing of information among users. While we may encourage users to report crimes to official authorities, the submission of a Crime Report via our Service does not constitute an official report to any law enforcement agency unless explicitly stated otherwise and confirmed by an official integration partner.

4.3. Accuracy of Information

You are solely responsible for the accuracy and legality of any Content, including Crime Reports, that you submit or transmit through the Service.

4.4. Compliance with Law

You agree to comply with all applicable laws and regulations in your use of the Service, including, but not limited to, the UK Online Safety Act 2023, the Online Safety and Media Regulation Act 2022 (Ireland), the General Data Protection Regulation (GDPR), and all laws related to defamation, privacy, and harassment.

4.5. Prohibited Content and Conduct

You agree not to post, upload, transmit, distribute, store, create or otherwise publish through the Service any of the following:

Illegal Content: Content that is unlawful, defamatory, libelous, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable.
Defamatory Content: Content that is false, misleading, or that defames, harasses, abuses, or threatens any person or entity. You acknowledge the significant legal risks associated with making false or unsubstantiated accusations.
False Reporting: Deliberately submitting false, misleading, or malicious Crime Reports or information.
Incitement: Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, national, or international law.
Privacy Violations: Content that discloses the private information of any third party without their express consent, including addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers.
Hate Speech: Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.
Impersonation: Impersonating any person or entity or otherwise misrepresenting your affiliation with a person or entity.
Spam or Advertising: Unsolicited promotions, political campaigning, advertising, or solicitations.
Harmful Software: Content that contains viruses, corrupted data, or other harmful, disruptive, or destructive files.

4.6. Content Moderation

We reserve the right, but are not obligated, to monitor, review, edit, or remove any Content, including Crime Reports, that we, in our sole discretion, deem to violate these Terms, any applicable law, or that we believe may be harmful or objectionable. We may also suspend or terminate user accounts that violate these Terms.

4.7. Reporting Misuse

You agree to report any Content or conduct that you believe violates these Terms or is otherwise inappropriate.

5. User-Generated Content

5.1. License Grant

By posting, uploading, or otherwise making available Content on the Service, you grant MyCrimeArea.tech a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such Content in connection with the Service and our (and our successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

5.2. Representations and Warranties

You represent and warrant that: (i) you own the Content posted by you on or through the Service or otherwise have the right to grant the license set forth in this section, and (ii) the posting and use of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person.

5.3. No Endorsement

We do not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with Content.

5.4. Disclaimer of Accuracy

We are not responsible for the accuracy or veracity of any Crime Reports or other Content posted by users. The information is provided by users and is not verified by us unless explicitly stated otherwise.

6. Paid Features and Subscriptions

6.1. Subscription Plans

The Service offers a Free Model and paid Subscription plans (monthly at £3.99 and yearly at £16.99) that provide access to enhanced features.

6.2. Billing

By selecting a Subscription, you agree to pay MyCrimeArea.tech the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a Subscription and will cover the use of that service for a monthly or annual subscription period as indicated.

6.3. Automatic Renewal

Your Subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. We will bill the Subscription fee to the payment method you provide.

6.4. Price Changes

We reserve the right to change our Subscription prices at any time. Any price changes will be communicated to you in advance, and you will have the option to cancel your Subscription before the new price takes effect.

6.5. Cancellations and Refunds

  • You can cancel your Subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing cycle.
  • Fees paid for Subscriptions are non-refundable, except as required by law. Specifically, we do not offer pro-rata refunds for partial annual subscription periods in the event of early cancellation.

6.6. Feature Changes

We reserve the right to modify or discontinue, temporarily or permanently, any features of the Subscription plans with or without notice.

7. Intellectual Property

7.1.

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of MyCrimeArea.tech and its licensors.

7.2.

The Service is protected by copyright, trademark, and other laws of both the United Kingdom and Ireland, and foreign countries.

7.3.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MyCrimeArea.tech.

9. Termination

9.1.

We may terminate or suspend your Account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9.2.

If you wish to terminate your Account, you may simply discontinue using the Service or follow the Account deletion process within the Service settings.

9.3.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

Important: Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

MyCrimeArea.tech its subsidiaries, affiliates, and its licensors do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

We do not warrant the accuracy, completeness, or reliability of any Crime Reports or other Content posted by users on the Service.

11. Limitation of Liability

In no event shall MyCrimeArea.tech, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Indemnification

You agree to defend, indemnify, and hold harmless MyCrimeArea.tech and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

a) your use and access of the Service, by you or any person using your account and password;
b) a breach of these Terms;
c) Content posted by you on the Service, including but not limited to any claim of defamation, infringement of intellectual property rights, or violation of privacy rights arising from such Content;
d) your violation of any law or the rights of a third party, including without limitation any privacy or intellectual property right.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of England and Wales for users primarily located in the UK, and the laws of the Republic of Ireland for users primarily located in Ireland, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

14. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
